These Terms and Conditions (“Terms”) govern your access to and use of the Seva Flows website and services (the “Services”)(“Seva Flows,” “we,” “us,” or “our”). By creating an account, starting a free trial, or otherwise using the Services, you agree to these Terms. If you do not agree, do not use the Services.
1. Eligibility and Accounts
You must be at least 18 years old and able to form a binding contract to use the Services.
You must provide accurate, complete information and keep it up to date.
You are responsible for safeguarding your login credentials and for all activity that occurs under your account.
If you use the Services on behalf of a business, you represent that you are authorized to bind that business to these Terms.
2. Description of Services
Seva Flows provides automated review management tools, including automated review requests via text and email, AI-assisted review responses, smart review routing, personalized images, social review posting, and integrations with Google Business Profile and third-party CRM or booking systems. We may modify, add, or discontinue features at any time.
3. Free Trial
We offer a 14-day free trial on eligible plans. Unless you cancel before the trial ends, your subscription will automatically begin and your payment method will be charged the applicable plan fee. You may cancel at any time during the trial to avoid charges.
4. Subscriptions, Billing, and Cancellation
Plans and pricing. Paid plans are billed monthly at the rates listed on our website ($99, $199, or $299 per month, depending on plan), which may change with notice. Each plan includes a stated number of review requests per month.
Recurring billing. By subscribing, you authorize us to charge your payment method on a recurring monthly basis until you cancel.
Cancel anytime. You may cancel your subscription at any time through your account or by contacting us. Cancellation takes effect at the end of the current billing period.
No refunds. Except where required by law, fees are non-refundable and we do not provide refunds or credits for partial billing periods or unused requests.
Taxes. Fees are exclusive of applicable taxes, which you are responsible for paying.
Failed payments. If a charge fails, we may suspend or terminate your access until payment is resolved.
5. Your Responsibilities and Acceptable Use
You are responsible for the content you send and the contacts you upload. You agree that you will:
Obtain all required consents from your customers before sending them SMS or email messages through the Services, in compliance with the TCPA, CAN-SPAM Act, applicable state laws, and mobile carrier rules.
Honor opt-out and unsubscribe requests and not message anyone who has withdrawn consent.
Comply with the policies of Google, Yelp, and any other platform, including their rules on review solicitation. You will not offer incentives for reviews, post fake or misleading reviews, or selectively suppress genuine negative reviews in violation of platform guidelines.
Not use the Services for unlawful, deceptive, harassing, or abusive purposes, or to send spam.
Not attempt to reverse engineer, disrupt, overload, or gain unauthorized access to the Services.
Ensure you have the right to upload and process any customer data you provide to us.
You are solely responsible for how you use review requests and routing features and for compliance with all applicable laws and third-party platform policies. Misuse may result in suspension or termination.
6. Third-Party Services and Integrations
The Services integrate with third-party platforms such as Google Business Profile and CRM or booking systems. Your use of those platforms is governed by their own terms and policies. We are not responsible for third-party services, their availability, or their handling of your data, and we may lose access to an integration if a provider changes its API or terms.
7. Intellectual Property
The Services, including all software, text, graphics, and trademarks, are owned by Seva Flows or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your internal business purposes. You retain ownership of the content and data you provide, and you grant us a license to use it as needed to operate and improve the Services.
8. AI-Generated Content
The Services use automation and artificial intelligence to draft and post review responses and generate images. You are responsible for reviewing and approving how this feature is configured and for the content published under your accounts. AI output may contain errors, and we do not guarantee its accuracy or suitability.
9. No Guarantee of Results
Statistics and testimonials on our website reflect the experiences of specific customers and are not a guarantee. We do not warrant any particular number of reviews, ratings, search rankings, revenue, or other results from using the Services.
10. Disclaimers
The Services are provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or secure.
11. Limitation of Liability
To the maximum extent permitted by law, Seva Flows and its officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or related to your use of the Services. Our total aggregate liability for any claim arising out of these Terms or the Services will not exceed the amount you paid us in the twelve (12) months preceding the event giving rise to the claim.
12. Indemnification
You agree to indemnify and hold harmless Seva Flows and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Services, your content, your contacts and messaging, or your violation of these Terms, applicable law, or third-party rights.
13. Suspension and Termination
We may suspend or terminate your access to the Services at any time, with or without notice, if you violate these Terms, create risk or legal exposure, or fail to pay fees. You may stop using the Services and cancel your subscription at any time. Upon termination, your right to use the Services ends, and provisions that by their nature should survive will continue to apply.
